EatClub Bookings general terms
Definition
For the purposes of these Terms of Service:
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Country refers to: Victoria, Australia
  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to EATCLUB PTY LTD 22 Wyandra st, Newstead, QLD, 4006
  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
  • Service refers to the Website and all EatClub services hosted on the https://eatclub.com.au and https://ecbookings.com address domains.
  • Terms of Service (also referred as "Terms") mean these Terms of Service that form the entire agreement between You and the Company regarding the use of the Service.
  • Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
  • Website refers to EatClub, accessible from https://eatclub.com.au and https://ecbookings.com
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
These are the Terms of Service governing the use of this Service and the agreement that operates between You and the Company. These Terms of Service set out the rights and obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms of Service. These Terms of Service apply to all visitors, users and others who access or use the Service. By accessing or using the Service You agree to be bound by these Terms of Service. If You disagree with any part of these Terms of Service then You may not access the Service.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.
Pricing Lite - EatClub Bookings Lite is provided for an additional $10/month on top of your EatClub membership while you are active on the EatClub platform.
Pricing Premium - EatClub Bookings Premium is provided for an additional $50/month on top of your EatClub membership while you are active on the EatClub platform.
Payments - Monthly subscription fees for the Lite and Premium plans are via direct debit or credit card payment only. Your billing period will start 7 days after you have been officially signed up to EatClub bookings and can access the EatClub Bookings platform. Your Membership fees, as agreed to in the form, will be charged in advance on a monthly cycle.
Inactive account - If at any point while using the EatClub Bookings platform, you become inactive, both EatClub Bookings Lite and Premium will be charged at $149/month as per EatClub’s standard pricing policy. If you are paying $149/month, you are entitled to use the premium version of the booking platform if requested. Active means at least 3 deals per week posted onto the EatClub platform.
Tablet - EatClub provides a tablet for use to process orders and bookings from the EatClub Marketplace. This can be used to manage EatClub bookings, However, any additional tablets required can be purchased at your own expense.
Cancellation - There are no contract lock-ins. You must submit a cancellation request to your account manager before the start of a billing cycle to avoid paying your monthly membership fee for the month ahead.
Migration of data - Should you, in the event of canceling your EatClub Bookings membership, require an export of bookings data to migrate to a new platform, a once off fee of $99 will apply. All exports will be provided in a .csv file and within 7 days of the request.
Customer Data - EatClub Bookings data will not be used for marketing in the wider EatClub ecosystem.
We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms of Service.
Upon termination, Your right to use the Service will cease immediately.
The laws of the Country, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.

Reserve with Google
Reserve with Google allows guests to make a booking for your venue directly from your Business Profile in Google Search and Google Maps. The Reserve a Table button on your profile allows guests to view your availability and make bookings. These bookings are automatically added to your EatClub account.
No, there are no fees. Using Reserve with Google with EatClub is completely free.
No, you will not be able to collect card details or charge deposits and prepayments for bookings made by Google. If payment feature is enabled in your EatClub account, you can still use Reserve with Google, however, these features won’t be supported in the bookings you receive from Google.
Yes, for bookings made through Google, the guest will be able to cancel or edit their booking through Google too. Google does not allow this functionality to be disabled.
No, your setting on how far in advance you accept bookings on the booking widget will not be reflected. With Reserve with Google, guests can always view your booking availability for the next 30 days. This cannot be customised.
EatClub supports terms and conditions that are specific to areas, days, and times, but Reserve with Google does not. This means your regular terms and conditions cannot be displayed.
We recommend that you create a new T&C for Reserve with Google bookings. These terms will always be shown in the Reserve with Google booking flow.
Yes, Google sends confirmation, reminder, cancellation and follow up emails for bookings made using Reserve with Google. Google also sends a modification email when guests edit their booking online using Reserve with Google.
Google does not allow these emails to be customised or disabled.
No, guests do not automatically receive EatClub Email & SMS to ensure they are not shown information that conflicts with the information shown in the emails Google sends. However, you can send your regular guests communications for a specific booking by selecting to send a confirmation email.
Google doesn't support options or custom fields, so guests will not be shown these when they book using Reserve with Google.
Yes, when booking from Google, guests can complete the optional “special request” box. The information guests enter here will be recorded as the customer comment for the booking.
Your minimum and maximum party sizes for each area will work if they are 10 or below. Guests cannot search for a party size larger than 10 using Reserve with Google. This is a limitation set by Google.
Yes, the areas that are visible on your booking widget will also be visible in the Reserve with Google booking flow.
