EatClub Pay Digital Prepaid Card Terms and Conditions
These Terms and Conditions apply to the EatClub Pay digital prepaid card (“the EatClub Pay Card”). The EatClub Pay Card is issued by EML Payment Solutions Limited ABN 30 131 436 532 AFSL 404131 (“EML”) and distributed by Vault Payment Solutions Group Pty Ltd, ABN 66 632 373 105 (“Vault”). In these Card terms and conditions, “we”, “us” or “our” means EML and Vault; and “you”, “your” or “user” means the cardholder. If you acquire the EatClub Pay Card you will have a contract with us.
When we refer to a:
Digital Wallet we are referring to Apple Pay, Google Pay or Samsung Pay or any other digital wallet provider capable of provisioning the EatClub Pay Card to your Device;
Device we are referring to a mobile or wearable device that allows you to store or otherwise add a EatClub Pay Card to a Digital Wallet;
Funding Card we are referring to an eligible credit or debit card provided by you at the time you register within the EatClub app that is used to fund transactions made using the EatClub Pay Card.
You agree to be bound by these Terms and Conditions by using the EatClub Pay Card in any capacity including, but not limited to, provisioning the EatClub Pay Card into your Device, using any EatClub Pay Card features or completing a transaction with the EatClub Pay Card.
Use and access to the EatClub Pay Card is subject to your respective Device capability. This means your Device must have the ability to store the EatClub Pay Card and make a purchase using a Digital Wallet.
You must first download and install the EatClub app, available from the App Store or Google Play Store, agree to the terms and conditions of the EatClub app and register your personal details.
You must also register a credit or debit card within the EatClub app to use as the funding source for transactions made using the EatClub Pay Card (Funding Card). Your Funding Card will not be charged at this stage and will only be charged when you present the EatClub Pay Card to make a purchase at a participating merchant.
The EatClub Pay Card is a digital prepaid card that can be used to access discounts and deals at participating merchants as indicated within the EatClub app, or EatClub website.
When you present the EatClub Pay Card to make payment at a participating merchant, the Funding Card you register within the EatClub app will be debited the value of your purchase.
You are responsible for ensuring there is sufficient funds available with your Funding Card for all transactions attempted to be made with the EatClub Pay Card. If there are no funds available with your Funding Card, you will need to finalise the purchase through an alternative method and you will not be eligible to receive the discount.
Attempts to use the EatClub Pay Card at merchants that are not otherwise approved to accept the EatClub Pay Card will result in a declined transaction.
The EatClub Pay Card does not have cash out capability, cannot be used to obtain or redeem cash and cannot be used for making direct debit, recurring, or regular instalment payments.
You acknowledge and agree that we do not provide you with paper statements. EatClub transaction activity information can be found by accessing the EatClub app. You are responsible for checking the transaction history of the EatClub Pay Card, which will be available to you on your Device by accessing the EatClub app.
You will be responsible for checking the transaction history of the Funding Card (through the provider of your Funding Card) to ensure the accuracy of all transactions made using the EatClub Pay Card.
The EatClub Pay Card is valid for three years as shown on the EatClub Pay Card within the EatClub app and cannot be used after expiry. After its expiry or cancellation, the EatClub Pay Card will be declined when presented for use.
If your EatClub Pay Card has expired, you will not be able to access discounts at participating merchants. We will issue you a new EatClub Pay Card on the expiry of your old card and you will need to provision your new EatClub Pay Card to your Device in order to continue to access the discounts offered within the EatClub app.
You are responsible for all transactions on the EatClub Pay Card, except where there has been fraud or negligence by our staff or agents. If you notice any error relating to the EatClub Pay Card, you should notify EatClub Customer Support immediately on 0485 840 525 during business hours or alternatively, you can send an email to hello@eatclub.com.au
Except to the extent required by law, we are not liable for any loss or damage arising out of or in any way related to the use of the EatClub Pay Cards, including:
  • If authorisation is declined for any transaction, except where the authorisation has been declined because of an act or omission on our part;
  • If you permit someone else to use the EatClub Pay Card, you will be responsible for any transactions initiated by that person with the EatClub Pay Card;
  • The availability of merchants who allow the use of the EatClub Pay Card as payment;
  • Reduced levels of service caused by the failure of third-party communications and network providers (except to the extent deemed liable under the ePayments Code).
Unauthorised transactions can happen using the EatClub Pay Card if the Device it is lost or stolen, a personal identification number (“PIN”) is revealed to any other person, or because of fraud.
We have some simple yet essential dining rules to follow to ensure your offer doesn’t become invalid.

There’s no need to tell staff you have an offer. When you tap your digital EatClub card, your offer will be automatically deducted from the total bill.

Not on the table or off it. Your offer cannot be used in conjunction with any others, includes specials.

Your offer will become invalid if you exceed the guest maximum, clearly stated on your redeemed offer.

Always be friendly to staff. Otherwise it can sour our relationship with the venue and result in offers being taken down.

Free cancellation before your arrival time, otherwise a $6 fee may apply.
Every offer on EatClub has a free cancellation period. This policy gives you plenty of flexibility to edit your offer or cancel if plans change. However, it also ensures that our customers only redeem offers that they need.
This policy is important part of keeping the EatClub community fair and respectful for everyone involved. When an offer goes to waste, it means that someone else misses out, and restaurants don’t fill that extra table that’s now staying empty. As offers are of limited supply, it makes it an extra precious resource gone to waste. Thanks for being apart of the EatClub community and we appreciate your understanding.
If you notice any error relating to, or have a query about, the EatClub Pay Card, you should initially contact EatClub by phoning Customer Support during business hours. EatClub Customer Support can be contacted on:

EatClub charges a service fee for using the EatClub Card payment system. These costs range from a minimum of 1% to 4% of the total amount charged to your EatClub Card, with a minimum fee of $0.20 AUD. Use of promotional codes within the app may attract additional fees. Additionally, to the extent permitted by law, some merchants may charge you for using the EatClub Pay Card with their EFTPOS terminal and such fees may be deducted from the balance of your EatClub Pay Card at the time of the transaction.
Any refunds on EatClub Pay Card transactions are subject to the policy of the participating merchant. If the EatClub Pay Card expires before you seek a refund from a participating merchant, then those may not be returned to your Funding Card.
You cannot “stop payment” on any transaction after it has been completed. If you have a problem with a purchase made with the EatClub Pay Card, or a dispute with a participating merchant, you must deal directly with the merchant involved. If you cannot resolve the dispute with the merchant, you can contact EatClub Customer Support.
By signing up to EatClub, you agree to accept and receive communication to the email you have provided, from or on behalf of EatClub.
This may include transactional communication. For example redeemed offer confirmations, payment receipts, cancelled orders etc. This can also include marketing communication. For example new offers, venues and general product updates, promotions and third-parties. It can also include communication from our support team that may be required to resolve and issues you might be having with your account.
For email communications that permit opting out (e.g., commercial/marketing messages), there is an opt-out mechanism in the messages. For transactional or relationship email messages, the only opt-out option is to delete your account.
Information will be disclosed to third parties about the EatClub Pay Card, or transactions made with the EatClub Pay Card, whenever allowed by law, and where necessary to operate the EatClub Pay Card and process transactions. Our Privacy Policies are available at:
